The Council received a significant amount of legal advice with regards to aspects of the proposed Bylaw. The advice has been sought over a lengthy period as different issue were raised. My view is that the information, both legal advice and also correspondence between officers and legal advisors is able to be withheld as it was sought and created as part of an evolving process. Viewed in isolation the information would not be able to be interpreted correctly and in the context it was sought or discussed. I rely on section 7 (2) (f) (i) and 7 (2) (g) of the Local Government Official Information and Meetings Act 1987 to withhold the information. The group set up a stall in Cuba Mall on Saturday 3 April to inform members of the public about the Bylaw, which would require people to have prior written permission from the Council in order to take part in certain activities in public, including performing, preaching, marching, holding public gatherings, and distributing written material. “The proposed bylaw is unnecessary, unreasonable and blatantly draconian,” said People for Public Places spokesperson, Russell Lee. “All Wellingtonians should take this threat to their fundamental human rights seriously and voice their opposition to the Council.” Amidst street theatre, music, face painting and dancing, People for Public Places handed out leaflets and invited the public to make submissions. The group’s efforts were well received by passers by, and 216 people made submissions opposing the Bylaw. In a similarly festive manner, People for Public Places will deliver these submissions to the City Council offices on Wakefield Street at 2pm on Monday 5 April. “Many people stopping at the stall for information were alarmed at the brief period allocated for public consultation on such an important proposal,” Mr Lee said. “If the proposed Bylaw is not withdrawn, the community at large will be restricted in freedom of expression and freedom of association, and subject to excessive regulation in a host of other areas.” “The council should better publicise proposals which affect our basic freedoms.
